Cycle of Hope Participant Terms & Conditions

1.This agreement is between North West Cancer Research and you and relates to your proposed participation in the Cycle of Hope, Sunday 26th June 2022.

2.North West Cancer Research reserves the right to revoke your registration at any point, in which case North West Cancer Research will return your registration entry fee.

3.The purpose of this agreement is:

3.1 to enable you to take part in the Cycle of Hope so that you can use your participation in it to raise money for North West Cancer Research; and

3.2 to fulfill your obligations and North West Cancer Research’s obligations in relation to the Cycle of Hope.

4.The event is organised by North West Cancer Research and will be provided by Chapeau EventsLtd on behalf of the Charity.

5.Once registered to take part in the event (in accordance with clauses 8, and 9 below) you will have a direct contract with North West Cancer Research.

6.All enquiries and requests for information before departure will be handled by North West CancerResearch, whose contact details are set out in Ride Summary and the website. You acknowledge that you will be contacted by email, phone, and or post in relation to the specific event you have registered for, ensuring North West Cancer Research can deliver the necessary administration and communication required to complete your successful participation in the event.

7.To be eligible for the event you must:

7.1 complete the registration form and pay a non-refundable entry fee of £20 and commit to raising an additional minimum sponsorship of £30; and

7.2 be over 16 at the time of booking unless otherwise agreed by North West Cancer Research; and 7.3 raise 100% of the sponsorship (£30) within 14 days following the event (10th July 2021)

8. You will only be entitled to take part in the event if you undertake or agree with the following:

8.1 North West Cancer Research receives from you the initial sum specified on the registration form;

8.2 The event which you are registering for is physically challenging and may pose a risk of discomfort, illness, injury, and even death. You need to be satisfied that you are physically capable of doing the event without undue risk to your health or life. We do not conduct health or fitness checks on entrants and the responsibility for your ability to participate in the event is with you as the participant.

8.3 North West Cancer Research (acting reasonably) is satisfied that your participation in the event is not likely to have a detrimental effect on the morale of the participants as a whole so as to make it likely that other participants will fail to complete the Cycle of Hope. You acknowledge you are fully responsible for your participation in the Event and North West Cancer Research does not accept responsibility or liability for any loss or damage arising from the Event.

9.North West Cancer Research will not provide alcohol during any stage of the Cycle of Hope. It will be the responsibility of the individual participant to be legally fit to take part in Cycle of Hope. Should an accident occur, and any participant be found to have exceeded legal alcohol limits, the charity's liability insurance will be invalid for that individual and the contract will be null and void.

10.The Highway Code must be obeyed and the wearing of a cycle helmet during the cycle challenge is compulsory at all times. Cyclists must ensure their bikes are roadworthy and serviced. North WestCancer Research will not be liable for personal injury, death, damage to property or other loss whether arising from accident, cancellation, delay, or any other matter beyond their control.

11.You agree that you will raise for North West Cancer Research the minimum sum specified in the Cycle of Hope information (£30) and you will use all reasonable endeavours to collect and send such minimum sum and all additional sponsorship pledged either to North West Cancer Research in cash,by cheque or added to an online fundraising page within 14 days after the end of the event.

12.You agree that in carrying out all fundraising for the benefit of North West Cancer Research you will comply with the following requirements:

12.1 You must make it clear you are fundraising in ‘aid of North West Cancer Research’ and are not representing North West Cancer Research. You must not do anything that may harm the reputation of North West Cancer Research or act in a manner contrary to our values. For any independent fundraising events that you carry out to raise funds, (e.g. cake sale, pub quiz etc.) you acknowledge that you are carrying such events out in your own capacity. It is your responsibility to organise all aspects of such event and make it clear that such event is run by you "in aid of" North West Cancer Research and is not run by us. You also agree to make it clear that such event is not "on behalf of North West Cancer Research" and that North West Cancer Research will not accept any responsibility or liability for such event. If you wish to use North West Cancer Research’s logo, please contact the events team who can provide a logo.

12.2 You agree to comply with the following financial procedures:

12.2.1 to pay all money collected on behalf of North West Cancer Research by cheque, onto an online fundraising page, or passed directly to North West Cancer Research in cash;

12.2.2 to send to North West Cancer Research any money you collect within 13 days of you receiving it

12.3 If you have to withdraw prior to the event, any money raised will be retained as a donation towards North West Cancer Research’s work. If you wish to refund your donors in this instance, you must ask your individual donors to make a written request to us, as they will be refunded directly.

12.4 You agree not to use fundraising materials other than those supplied to you by North West Cancer Research for the purposes of the Cycle of Hope.

13. North West Cancer Research will use all reasonable endeavors to ensure that the Cycle of Hope takes place so far as reasonably possible in accordance with the information provided. However, North West Cancer Research may make such alterations to the arrangements as they may reasonably require.

14.You acknowledge that any photography or film footage taken as part of your participation in the event can be used for promotional and marketing purposes for this specific event and any futureNorth West Cancer Research events activity.

15.If you choose not to participate in the Cycle of Hope or if you do not become eligible to take part in the Cycle of Hope or if North West Cancer Research prevents you from doing so, all sums collected or pledged will still be payable to the charity; the entry fee is not refundable in any other circumstances.

16.This agreement constitutes the entire agreement and understanding between North WestCancer Research and you relating to the event and supersedes all other prior representations, agreements, or arrangements whether written or oral, express or implied relating to the Cycle of Hope.

17.This agreement is governed by English law and you and we irrevocably submit to the exclusive jurisdiction of the English courts.

18.By accepting these terms, to take part in the Cycle of Hope, you agree to be bound by these conditions.
